On October 26, 2015, the Government Accountability Office (GAO) issued a decision In the Matter of FedServ-RBS JV, LLC, File No. B-411790. Although this case is consistent with current precedent and applicable regulations, it highlights several things, including: the significant challenges 8(a) Joint Ventures (JV) face in getting approval; the power the Small Business Administration (SBA) holds relative to 8(a) JVs being awarded 8(a) contracts; and the fact that contracting agencies are forced to award contracts to second place bidders (which may not be the lowest price or even the best value) if the SBA fails to timely approve a JV application. |

The Native Hawaiian Organizations Association's (NHOA) 1st Annual Business Summit Conference took place on August 5 and 6 at the Pacific Beach Hotel in Waikiki. The theme of this year's conference was "Kina'ole - doing the right thing, in the right way, at the right time, in the right place, to the right person, for the right reason, with the right feeling...the first time!"
Holomua Consulting Group will be presenting a series of workshops covering various topics critical to the growth and success of small to medium-sized businesses in the federal contracting industry. The goal of these workshops is to provide attendees with information on a wide range of topics which are applicable and relevant to government contractors. We are in the process of finalizing the details (dates, location, etc.) and workshop schedule for the rest of 2015, but the first workshop of the 2015 Workshop Series has been set. The first workshop in the Workshop Series will be free of charge and will be held on January 21, 2015 from 8:30 - 10:00 a.m. at the Honolulu International Airport Interisland Terminal Conference Center. The Conference Center is located on the top level (7th Floor) of the interisland parking structure. This first workshop will provide an introduction to government contracting and small business set-aside programs, including the 8(a) Business Development program administered by the SBA. For more information and to register, please click on the button below: The U.S. Small Business Administration (SBA) establishes size standards that are used to determine if a business is “small” and, thus, eligible for Federal government programs and preferences. These size standards, which can be found at 13 CFR §121, are established by industry, generally under the North American Classification System (NAICS).
As expected, the SBA 8(a) Business Development Program made the SBA Office of Inspector General's list of top management challenges facing the SBA in Fiscal Year 2015. On October 17, the OIG issued its Report on the Most Serious Management and Performance Challenges Facing the Small Business Administration In Fiscal Year 2015. According to the Inspector General, the report represents the OIG's "current assessment of Agency programs and/or activities that pose significant risks, including those that are particularly vulnerable to fraud, waste, error, mismanagement, or inefficiencies."
